Scope

The rules and procedures, privacy policy, and terms of use (ToU) published on the website (available at: [__Slaw.solutions____]) govern your use of the website, the portal, and any online dispute resolution services (ODR Services) provided by the service provider (Slaw) to you (You or User). If there is a conflict between a provision in the ToU (as amended from time to time) and a provision in a specific written agreement that Slaw has entered into with You (Specific Agreement), the specific agreement will take precedence over these ToU to the extent that it affects Slaw and You. References to the R&P and PP published on the Website and its subsequent updates are considered an integral part of these ToU. The definitions assigned to capitalised phrases under the R&P will apply in cases where these ToU do not specify them.


A dispute is deemed a "Active Dispute" once all parties involved in the dispute have accepted one party's invitation to use Slaw's Portal for online dispute resolution (ODR) services, and Slaw has agreed to provide access to its Portal to all parties involved in the dispute. Slaw reserves the right to suspend, terminate, or restrict access to the ODR Services for any party involved in an Active Dispute if they or the User violates these Terms of Service. It is the User's exclusive responsibility to familiarise themselves with and abide by any Pakistan laws, rules, and regulations that may be relevant to their use of the Website, Portal, and ODR Services.


Using Slaw's online dispute resolution (ODR) services or receiving an award from a DRP in an active dispute does not, and does not imply that Slaw expresses or intends to express any legal opinion or view on any provision of law. The User and any other parties involved in the Active Dispute are the only ones who should rely on any Slaw Communication—an award, order, settlement proposal, direction, or any other type of written or oral communication—issued by Slaw or a DRP. The Slaw Communication should only be used, quoted, or referred to in the context of the issues it addresses, and not in any other document or for any purpose other than what is explicitly stated in the Slaw Communication. The only exception to this rule is when an appeal is filed regarding the award.


Access to the ODR Services on the Portal under these TOU is contingent upon the User's timely payment of any fees specifically agreed upon in writing between the User and Slaw, as updated from time to time.


The User confirms and affirms that they have independently determined the validity and enforceability of the inter-se agreement between the parties to an Active Dispute that is the basis for its reference to Slaw, and that Slaw does not have any authority over such matters.


Except as expressly provided above, the Portal shall not enable the use of arbitration for the purpose of resolving disputes that are not subject to arbitration under the laws of Pakistan. Slaw makes no guarantee that using the Portal to access the ODR Services in connection with an Active Dispute is permissible with respect to its settlement under relevant laws. Assuming the User has reasonable belief that doing so would not violate any laws, the User may use the Portal and ODR Services to resolve an Active Dispute. According to Slaw, the following issues are 'non-arbitrable' under the relevant laws:


Relating to rights and liabilities which give rise to or arise out of criminal offences.


In cases of marital dissolution, judicial separation, restoration of conjugal rights, and child custody battles.


Care issues related to guardianship.


Issues pertaining to insolvency or winding up.


Issues pertaining to bequests (such as a certificate of succession, letters of administration, or a grant of probate).


That result from the Pakistan Trusts Act or from a trust deed.


Competition and antitrust statutes.


Committing fraud.


Conflicts involving consumers in which one or more parties have sought resolution through the National Consumer Disputes Tribunal.



Qualifications, Limitations And Obligations


Either the User is an Pakistan citizen with legal contracting power or it is a fully incorporated Pakistan body corporate.


Access to the ODR Services on the Portal has been granted to the User on the condition that the User will not, under any circumstances, engage in the following:


Use or attempt to use Slaw 's systems in an automated way, or do anything that, in Slaw's opinion, puts an undue or excessive strain on Slaw's servers or network infrastructure; to clarify, this won't apply to anything a User does with Slaw's prior consent.


You are not allowed to circumvent any computer program or system that Slaw uses to distinguish between human and machine input, prevent spam or automated data extraction, use any software, technology, or device to scrape, spider, or crawl the Website or the Portal, or harvest or manipulate data belonging to Slaw or any ODR Service users.


Gives evidence, testimony, or witness statements that are intentionally false, misleading, deceptive, falsified, or inaccurate, or utilise the ODR Services for any illegal or unlawful purpose.


Post or engage in abusive, offensive, threatening, obscene, defamatory, casteist, sexist, pornographic, or otherwise harass, threaten, or victimise an individual or group based on religion, gender, sexual orientation, race, caste, ethnicity, age, or disability; this does not apply if the material in question is an integral and necessary component of the User's claims, pleadings, or counter-claims included in an ongoing Dispute.


Unauthorised use of another user's Portal account is strictly prohibited. To clarify, for the purposes of this provision, all accounts held by an institutional user are considered to be those of the same user.


Enter information that is not true, deceptive, or falsified while creating an account.


To use or access the Portal or the ODR Services in a way that is not authorised by Slaw; to disrupt, disrupt, or try to disrupt the correct operation of the Portal or the ODR Services.


Distribute harmful content with the intent to harm or impede the operation of another user's browser or computer.


Unless explicitly allowed as part of the ODR Services provided in relation to the Active Dispute or as agreed with Slaw, users are not allowed to edit, translate, download, print, archive, display, adapt, enhance, decompile, disassemble, reverse engineer, exploit commercially or otherwise, create derivative works from, make copies or archives of the Website, the Portal or any content thereon for any purpose. Users must also obtain Slaw's prior consent for any action taken with their consent.


Enable unauthorised third parties to access or use the Website, the Portal, or the ODR Services.


Utilise the Portal, the Website, or the ODR Services in a way that would cause harm to, threaten, impersonate, harass, or deceive another person or entity.


Engage in any activity that could jeopardise the security of the Website or the Portal, such as hacking or infiltration.


Compromise or try to compromise the security of any third party's or the Website's or Portal's or any third party's software, network, servers, data, computers, or other hardware.


Violate the law on any level (federal, state, regional, or local).


The User understands and consents to the fact that:


According to the User, there is no reason to suspect that the User will gain any unfair or malicious advantage by using the ODR Services, the Website, or the Portal in connection with the current Dispute.


Regardless of the outcome of the ongoing Dispute, the User is entirely responsible to Slaw for the service fees associated with applying or using the ODR Services.


If the User has any information that Slaw or the DRP needs regarding the active Dispute, they should try their best to provide it to them as soon as possible so that the Active Dispute can be resolved as soon as possible. This includes any data, content, messages, graphics, drawings, sound and image files, photographs, recordings, software, etc.


To use the ODR Services fairly, justly, and transparently in regard to the active Dispute, the User must have all the required equipment, systems, connectivity, resources, abilities, knowledge, competency, technological awareness, and more.


Any problems, mistakes, crashes, or other unfavourable occurrences that the User causes while using the Website or the Portal are not Slaw's responsibility.


Slaw and any licensors of Slaw, if any, shall own all right, title, and interest in the Website, the Portal, and any software owned, produced, or utilised by Slaw (Software) in relation to the ODR Services.


Slaw grants the User a limited license to use the ODR Services on the Portal for the Active Dispute as described herein. The User acknowledges that Slaw owns all intellectual property rights, interests, and titles to the Website, the Portal, the Software, and any other related matters.


In the absence of a legitimate need to do so in order to resolve an active dispute, Slaw does not want or need the User to provide any personally identifiable information, financial details, trade secrets, or other sensitive information through the Portal or electronic mail. Any confidential, secret or proprietary information, personal data, any ideas, concepts, methods, systems, designs, plans, techniques or other similar materials submitted or sent by the User to Slaw , in relation to an Active Dispute (User Content)through the Portal, by e-mail, or in any other way aresubject to any applicable privacy obligations of Slaw under the PP or any separate written agreementsentered into by Slaw with the User;Slaw does not review, filter, pre-screen, monitor, or otherwise edit User Content posted, or otherwise made available to any other person, on or through the Portal; however, Slaw reserves the right (but assumes no obligation) to, at its sole discretion, refuse, filter out, pre-screen, edit or remove any User Content, in whole or part, that, does not comply with these ToU, is illegal, or is otherwise undesirable or inappropriate from any members’ forum, public forum, message boards or comments sections on the Website or the Portal that can also be accessed by persons other than the User, Slaw and the DRPs.


In order to facilitate settlement, Slaw will maintain the confidentiality of all communications and evidence pertaining to intake, case assessment, settlement discussions, negotiation, and mediation. These discussions may take place through the Platform or Slaw-initiated video hearings, phone calls, or any other means of communication. Further, the Parties understand and agree that they will not do anything that would bring disrepute upon one another or that would likely result in adverse press for either of them. Information acquired or obtained outside of the Slaw dispute resolution process is not subject to this confidentiality restriction.


Slaw reserves the right to limit, suspend, or revoke the User's access to the Website, the Portal, or the ODR Services at any time in response to a breach, or reasonable belief of a breach, of these Terms of Service. This right is in addition to Slaw's other rights. At any moment, Slaw may modify, add, or remove any ODR Service or feature from the Portal, or even stop providing the Portal altogether. On the other hand, if a User has already paid Fees to Slaw for a feature or ODR Service, Slaw cannot remove it without their consent. Instead, Slaw can replace it with a similar feature or ODR Service that complies with all legal requirements.


Indemnity


The User's use of the Portal, the ODR Services, and the Website, as well as any breach of these Terms of Service by the User, shall cause Slaw and its affiliates, directors, officers, and employees to be held harmless from any claims, liabilities, costs, or expenses, including reasonable legal fees, that may arise from such use.


No Liability For Lost Data


It does not matter if it is due to a computer virus, unauthorised access, malicious attack, or anything else; Slaw isn't responsible for any loss, deletion, removal, or failure of delivery ("Losses") to the intended receiver of any User Content. It is highly recommended that the User keeps an additional copy of any User Content.


Exclusion Of Liability And Warranties


Your use of the website and the portal is at your sole risk, which is provided on an “as is” and “as available” basis. We and our licensors expressly disclaim all warranties of any kind, whether express or implied. We do not guarantee the accuracy, completeness, justness, fairness, neutrality, validity or usefulness of the odr services, any award or settlement made by any drp, any other service or content provided by slaw , and you rely on the odr services, the drp allocated for an active dispute and other service or content of slaw at your own risk. Any material that you access or obtain through our services is done at your own discretion and risk and you will be solely responsible for any damage to your computer or loss of data that results from the download of any material through our to the maximum extent permitted by applicable law, we and our licensors will not be liable for any direct, indirect, incidental, special, consequential, or exemplary losses or damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if we have been advised of the possibility of these damages), resulting from your use of the odr services, the portal or the services of the drp allocated to your dispute. Under no circumstances will the total liability of slaw and our licensors of any kind arising out of or related to your use of the services (including but not limited to warranty claims), regardless of the forum and regardless of whether any action or claim is based on contract, tort, or otherwise, exceed the amounts, if any.


Miscellaneous


These Terms of Service can be changed by a written amendment signed by an authorised Slaw executive or by Slaw posting a new version of the Terms of Service on the website. If there is a conflict between a provision of the new Terms of Service and any specific agreement, the specific agreement will take precedence as far as the dispute is between Slaw and the user for whom the specific agreement was executed.


The laws of Islamic Republic of Pakistan, including its conflict of law provisions, will govern these Terms of Service and any access or use of the Website or the Portal.


The User acknowledges and accepts that Slaw may use the User's name and likeness in promotional materials and on the Website.


By responding to a message on the Slaw ODR platform, the user gives Slaw permission to record his or her choice.


Any provision of these Terms of Service that is determined to be invalid or unenforceable shall be construed in a way that gives effect to its intended intent, and the other provisions shall remain fully enforceable. Whilst any party may temporarily or permanently waive a term or condition of these Terms of Service or any breach thereof, this will not apply to any future breaches of the same or any other term or condition.


The User is required to obtain Slaw's explicit written agreement before assigning their rights under these TOU to any third party. Slaw, on the other hand, is free to assign its rights under these TOU without any conditions. The parties and their authorised assigns will benefit from these Terms of Service and they will be legally binding upon them.
